The Baseline Report for the Fulfillment of the Industry Emissions Directive (IED)

The Directive 2010/75/EU on industrial emissions, passed by the European Union on November 24th, 2010, became German law on April 8th 2013 when the law to implement these measures went into effect. This makes it mandatory for the operators of industrial installations to systematically monitor their installations. About 9,000 companies in Germany from a wide variety of branches are affected by the IED:

  • Energy
  • Chemical
  • Metal processing
  • Mineral processing
  • Waste management
  • Paper production
  • Livestock farming
  • etc.

The limit values have been tightened and standardized throughout Europe. The best available technique (BAT) should be determined using the BAT reference documents and utilized during the approval process. Thus, a unified standard throughout Europe should be achieved, thereby allowing fair competition.
Ac­cording to the IED, the baseline report is part of the process of issuing authorizations. This report describes the condition of the installation's site before the beginning of its usage. According to §5 par. 4 of the BImSchG (German Emissions Law), the operator of the installation is legally required to bring the site back to its original condition after the operations are ceased. Adverse effects on the soil and/or groundwater quality that arose from the usage of the site must be precisely documented with reference to the report generated at the point in time before its usage. Accordingly, the operator should be motivated to obtain as comprehensive a baseline report as possible before the authorization. The baseline report is an essential component of the authorization process and absolutely must be submitted to the authorities before the installation is put into operation. Any "relevant, hazardous substances" that are used, generated, or emitted in the installation and could lead to soil or groundwater contamination should be described specifically.
